Terms of service
Effective date: September 23, 2026
These terms cover two things: your use of claryhomes.com, and the packages, prices and offers we publish on it. By using the site or contacting us about a project, you agree to them. Your project itself is governed by the written contract you sign with Clary Homes, and if anything here conflicts with that contract, the contract wins.

Part 1: Package and offer terms
Prices on the website
Package prices shown on the site are starting prices for the package as described, and are current at the date shown at the top of this page. We may change or withdraw packages and prices at any time. The price you pay is the price in your signed contract, not the price on the website.
What a package price assumes
Each package price assumes a standard residential lot in our service area that is reasonably level, with clear access for materials and equipment, no existing structures to remove, and utilities within normal reach of the work. If your property differs, the additional work is quoted separately after the free consultation and you decide whether to proceed. Examples of work not included in a package price:
- Permits, plan checks and any fees charged by your city or county
- Engineering, soil reports or surveys where required
- Grading, retaining walls, drainage work or soil removal needed to create a level area
- Demolition or removal of existing concrete, decking, structures or trees
- Gas, water or electrical runs beyond a standard distance from the house
- Difficult access, including crane work or hand-carrying materials
- Upgrades to materials, sizes or appliances beyond what the package lists
What’s included
The items included in each package are listed on the Packages page. Photographs and images on the site are for illustration. Some show previous Clary Homes projects; some are 3D renders or AI-generated images used to demonstrate a design or a finish, and are not photographs of completed work. Colors, finishes and exact layouts vary by property and are confirmed in your design and contract. Where a package lists a size, that is the size supplied; larger sizes are quoted separately.
Free consultation
The consultation is a free visit to your home to look at the yard, talk about what you want and confirm which package or custom approach fits. It carries no obligation. Rough estimates given over the phone or at the consultation are estimates only and are not a quote.
3D design
A 3D design of your yard is available for a fee of $500. If you go ahead with a Clary Homes project, the $500 is credited in full against your contract price. If you decide not to go ahead, the design is yours to keep and the fee is not refunded. The design remains subject to site conditions, permitting and the final contract.
Financing
Financing is offered on every package through third-party lenders. Approval, rates and terms are set by the lender, are subject to credit approval, and are not guaranteed by Clary Homes. We do not provide credit ourselves.
Contracts and changes
Every project is set out in a written contract that states the scope, price, payment schedule and timeline. Changes to the scope after signing are agreed in writing and may change the price and timeline.
Your right to cancel
You may cancel a signed contract for any reason within three business days of signing. If you are 65 or older, you may cancel within five business days. To cancel, notify us in writing by email to sales@claryhomes.com or by post to the address above before the deadline; the date you send it counts. Any payment you have made will be returned. Your contract includes a Notice of Cancellation form setting out this right, as California law requires. After the cancellation period, cancellation is handled as set out in your contract.
Timelines
Timelines given on the website or at the consultation are indicative. Your contract will contain a schedule. Weather, permitting, material availability and site conditions can affect it, and we will keep you informed if they do.
Service area
We serve San Diego County and parts of Riverside County. Availability in a given area is confirmed at first contact.
Warranties
Any warranties that apply to your project, including manufacturer warranties on products we supply, are set out in your contract and the manufacturers’ own documents. Nothing on the website is a warranty.
Part 2: Website terms
Use of the site
The site is provided for information about our services and for contacting us. You may not use it in any way that is unlawful, that interferes with its operation, or that copies or scrapes its content for commercial purposes.
Content
Text, photographs, designs, videos and the Clary Homes name and logo are owned by Clary Homes or used with permission. You may not reproduce them without our written consent. Images on the site include photographs of Clary Homes projects and, in some places, 3D renders or AI-generated images used for demonstration purposes.
Accuracy
We try to keep the site accurate and current, but we do not guarantee that it is free of errors or that any package, price or product will remain available. Nothing on the site is professional advice about your specific property.
Third-party services
The site uses forms, analytics, video and other services from third parties, and links to other websites including social media and lenders. We are not responsible for those services or sites or their content.
Limitation of liability
To the extent permitted by law, Clary Homes is not liable for any loss arising from your use of the website or reliance on its content. This does not limit any liability under your signed contract or any liability that cannot be excluded by law.
Privacy
How we handle your personal information is described in our Privacy policy.
Governing law
These terms are governed by the laws of the State of California. Any dispute about the website will be dealt with in the courts of San Diego County. Disputes about a project are handled as set out in your contract.
Changes to these terms
We may update these terms from time to time. The effective date at the top shows when they were last changed.
